This Tank Safety & Compliance Policy outlines the conditions your oil tank must meet, when our drivers can or cannot make a delivery, and what responsibilities rest with the customer. From the “no whistle, no fill” rule to trip fees for inaccessible tanks, these policies protect your property, our drivers, and the environment while ensuring fair, reliable service.

Tank Safety & Compliance Policy & Service Terms

At Same Day Oil Delivery, safety and environmental protection come first. These terms explain
when we can deliver, what customers are responsible for, and how we handle tank safety, access, and payment issues.

  • No whistle, no fill: an operational overfill alarm (vent whistle) is required on all tanks.
  • Safe connection required: fill and vent must be accessible and in good condition.
  • Trip fee: if the tank is full or takes <25 gallons, you’ll be billed at the 25-gallon tier plus a $50 trip fee.

1. Tank Safety Standards

  • Tank bottom, seams, legs, and base show no obvious signs of failure (active leaks, wet spots, severe bulging, collapsed supports, cracks).
  • Tank base is solid, stable, and level, with no signs of sinking or rocking.
  • Rust/paint wear are common; we have no way to determine if rust is superficial or structural. If rust appears excessive or concerning, delivery may be refused.
  • Fill and vent pipes are accessible and in good condition. Vent pipe has a cap and fill pipe has a cap/cover. We must be able to make a safe and complete connection.
  • Operational overfill alarm (vent whistle) required on all tanks. No whistle, no fill.

2. Driver Role & Limitations

  • Drivers perform a basic exterior visual assessment only; they are not licensed tank inspectors.
  • We cannot determine internal condition or predict future failure.
  • Deliveries often occur outside daylight hours or in inclement weather, limiting visibility.
  • A completed delivery does not certify, warrant, or acknowledge that the tank is safe, sound, or compliant.

3. Refusal of Delivery

         Drivers are authorized and required to refuse delivery if they observe:

  • No operational vent whistle.
  • Active leaks, wet spots, or obvious signs of failure; severe corrosion, bulging, instability, or rocking.
  • Unsafe, damaged, or inaccessible fill/vent piping; unsafe access pathways (icy steps, cluttered yard, unstable ground).
  • Hazards preventing safe access (snow/ice, locked gates, blocked driveways).
  • Unrestrained animals (including dogs) that may pose a threat; pets must be secured.

4. Tank Inspections

  • Drivers conduct a basic visual check only when conditions allow.
  • We may require a formal inspection by a licensed technician before continuing service.
  • Customers should schedule professional inspections every 3–5 years for aboveground tanks and follow all UST/UST-equivalent local rules.

5. Unsafe or Non-Compliant Tanks

  • No delivery until unsafe conditions are repaired or tank is replaced.
  • Referral available to Superior Tank & Energy for evaluation, removal, or replacement.
  • Unsafe examples: visible leaks, saturated base, broken legs/supports, severe rust, bulging, rocking, or missing whistle.

6. Customer Responsibility

  • Maintain tank, piping, and base in safe, serviceable condition.
  • By ordering, you certify your tank meets minimum safety standards and access is safe/clear.
  • You are liable for all leaks or spills caused by your tank, whistle, or piping. If an overfill occurs due to a defective whistle/vent, responsibility lies with the customer.

7. Basement Tanks

  • Drivers cannot access inside the property and do not perform interior inspections.
  • We are not responsible for leaks, failures, or spills that occur inside the property during or after delivery.
  • Any indoor damages, remediation, or cleanup from basement tank failure are the sole responsibility of the customer.

8. No Warranty & Limitation of Liability

We provide no warranty of merchantability or fitness for any particular purpose regarding customer-owned tanks, piping, or equipment, and no guarantee of safety, performance, or compliance. Liability is strictly limited to the value of fuel delivered. Once fuel enters the tank it becomes the customer’s property and responsibility.

9. Indemnification

By accepting delivery, customer agrees to indemnify and hold harmless Same Day Oil Delivery from any claims, damages, or costs (including environmental cleanup, property damage, or third-party claims) arising from tank leaks, spills, or failures beyond our control.

10. Environmental & Neighboring Property

If a leak or spill from the customer’s tank impacts neighboring property, soil, or groundwater, the customer is solely responsible for all cleanup, remediation, and reporting (e.g., PA DEP / NJ DEP) and associated costs.

11. Tank Identification & Out-of-Service Tanks

  • Be very specific when ordering and clearly identify which tank to fill. The driver is not responsible if incorrect or unclear instructions lead to filling the wrong tank.
  • Out-of-service/abandoned tanks must have fill pipes permanently capped, or the tank removed/decommissioned. We do not deliver to abandoned/condemned/non-active tanks.

12. Trip / Return Fee

  • $50 trip fee if dispatched but unable to complete delivery due to any of the following:
    • Tank already full.
    • Tank takes <25 gallons. You will be charged at the 25-gallon price tier for the fuel delivered plus a $50 trip fee.
    • Locked gates/fences, blocked fill pipe, unsafe access pathways (icy steps, cluttered yard, unstable ground).
    • Aggressive/unrestrained animals (including dogs) in the delivery area.
    • Tank deemed unsafe/non-compliant.
    • Unclear/incomplete/incorrect instructions about which tank to fill.

13. Price, Taxes & Surcharges

  • Fuel prices are market-based and may change at any time.
  • Orders are billed at the confirmed price at time of order unless otherwise specified.
  • Customer is responsible for applicable taxes, environmental fees, and regulatory surcharges.

14. Automatic Delivery Disclaimer

For auto-delivery, schedules are based on degree-day calculations, usage history, and tank size estimates. We are not responsible for run-outs caused by unusual usage, unreported equipment changes, or tampering.

15. Property Damage Disclaimer

Normal delivery access may require driving on driveways, lawns, or near landscaping. We are not responsible for minor property damage (tire tracks, cracked driveways, landscaping impact) caused by normal access.

16. Payment, Disputes & Chargebacks

  • Payment due at time of order or delivery, depending on method.
  • Disputes or chargebacks do not relieve responsibility for fuel delivered, trip fees, or related charges.
  • Disputed payments/chargebacks/returned checks may incur:
    • $35 administrative service fee per occurrence, and
    • 1.5% interest per month (18% APR) on outstanding balances until paid in full.
  • Customer is responsible for all collection costs, attorney fees, and third-party recovery fees.

17. Force Majeure & Service Rights

We are not liable for delays or non-delivery due to weather, traffic, accidents, equipment failure, supply shortages, or other circumstances beyond our control.
We may deny or discontinue service to any unsafe or non-compliant tank at our sole discretion.

18. Governing Law & Venue

These terms are governed by Pennsylvania law. Exclusive jurisdiction and venue for any dispute lie in the courts of Bucks County, Pennsylvania.

19. Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.

20. Entire Agreement

This policy constitutes the entire agreement between Same Day Oil Delivery and the customer for oil delivery, tank condition, and payment, and supersedes any prior agreements or representations.

Legal Notice: Filling a tank does not mean we inspected, approved, certified, or guaranteed the tank in any way.
The customer remains fully responsible for the tank’s integrity, maintenance, and compliance.

  • Fuel ownership: once fuel enters the tank, responsibility transfers to the customer.
  • Payment, disputes & chargebacks: $35 admin fee + 1.5%/month interest on unpaid balances; customer liable for collections/attorney fees.
  • Governing law & venue: disputes resolved exclusively in Bucks County, Pennsylvania.
